I read in a news article a few years back (I still have the article) that per California Statute 1748.1 merchants are not allowed to pass on interchange fees to costumers in the form of a surcharge added to the card. So, it would stand to reason that a merchant can not pass back interchanges fees in this Fashion. Also, most major credit card companies have contracts with retailers that prohibit them from passing back interchange fees as it would discourage people from using credit cards. Retailers can however offer discounts for using cash or check versus credit cards. If your credit card has a surcharge added to it I would question the retailer and depending on how much you want to fight it you have a legal recourse.
